JUDGMENT ENTRY DIEDRE COLE DEFENDANT. _________________________________/ This matter came on for hearing this 20th day of March 2023 on the Forcible Entry and Detainer Complaint filed by the Plaintiff and the Counterclaim filed by the Defendant. Present were the Plaintiff, represented by attorney Robert E. Feighner, Jr. and the Defendant, represented by attorney Steven Black. The parties were previously before the Court on February 27th, 2023 and jointly requested a continuance of the proceeding to discuss settlement of the case. The Court granted the request and the case was set for hearing on March 20th, 2023. The Defendant’s Counterclaim alleges damages in excess of $15,000.00, the monetary jurisdiction of the Court. Defendant requested the matter be transferred to the Hancock County Common Pleas Court. Plaintiff did not object to the request and did not, at any time, file a motion to strike the Counterclaim as frivolous or improper. The Court reviewed the Defendant’s Counterclaim and finds the issues raised by it are directly related to the right of possession of the premises, and intertwined with Plaintiff’s Complaint for Forcible Entry and Detainer. Additionally, the Court finds Defendant’s Counterclaim alleges over $15,000.00 in damages and exceeds the monetary jurisdiction of the Court. Therefore, the Court hereby ORDERS, ADJUDGES AND DECREES that Plaintiff’s Complaint and Defendant’s Counterclaim be transferred to the Hancock County Common Pleas Court and certifies the entire proceedings in this case over to the Hancock County Common Pleas Court. s/by Alan D. 3/20/2023 This day this cause came on for the Court’s attention upon the request of the Findlay Publishing Company (The Courier), a Findlay, Ohio newspaper, for access to all public proceedings in this cause. The Court, having reviewed the request received from the aforementioned, copies of which were filed on March 20, 2023 for purposes of the record, hereby ORDERS pursuant to Superintendence Rule 12 of the Rules of Superintendence for the Courts of Ohio that said request shall be granted and access be permitted to all public proceedings in this cause as follows: Pursuant to written request The Courier shall be permitted both video and audio equipment, and one (1) technician to operate the same in the courtroom located at the Findlay Municipal Court in the Findlay Municipal Building; All photographic and/or other camera equipment shall be operated from a designated news media area in the courtroom; There shall be a minimum of noise and distraction and all media devices shall be operated as unobtrusively as possible; Recordings on film or tape shall be confined only to open court proceedings. Operators of such equipment are to refrain from recording any side-bar conference between court and counsel; Arrangements between or among media for “pooling” of equipment shall be the responsibility of the medial representative authorized to cover the proceedings. “Pooling” arrangements are to be made outside the courtroom and without imposing on the judge or court personnel. Still photographers and television and radio representatives shall be afforded a clear view but shall not be permitted to move about in the courtroom during court proceedings from the places where they have been positioned by the judge; except to leave or enter the courtroom. No victim or witness that objects to being filmed, videotaped, or photographed shall be filmed, videotaped, or photographed. Revocation of permission. Upon the failure of any media representative to comply with the conditions prescribed by this rule or the judge, the judge may revoke the permission to broadcast or photograph the trial or hearing.
