THIS DAY THIS MATTER CAME BEFORE THE COURT ON DEFENDANT'S MOTION TO HAVE A COURT MODIFICATION LETTER TO REMOVE BMV CONVICTION. DEFENDANT'S MOTION REQUESTS THIS COURT FOR AN ORDER DIRECTING THE OHIO BMV TO REMOVE THE APPARENT CONVICTION FOR THE UNDERLYING OVI OFFENSE.
ON JUNE 8, 2026, THIS COURT ISSUED ITS JUDGMENT ENTRY FORFEITING DEFENDANT'S BOND FOR FAILING TO APPEAR BEFORE THE COURT. THE MATTER WAS THEN CLOSED AND THE CASE WAS DISMISSED. THE COURT SPECIFICALLY INDICATED THAT THERE WAS NO CONVICTION FOR THE UNDERLYING CHARGE OF OPERATING A VEHICLE WHILE UNDER THE INFLUENCE OF ALCOHOL OR DRUGS OF ABUSE OR A REFUSAL.
THE JUDGMENT ENTRY WAS FORFEITURE WAS REPORTED TO THE OHIO BMV BY THE COURT. UPON REVIEW, THE OHIO BMV HAS LISTED THE MATTER AS A "FORFEITURE" AND DOES NOT SHOW A CONVICTION FOR OPERATING A VEHICLE WHILE UNDER THE INFLUENCE OF ALCOHOL OR DRUGS OF ABUSEOR A REFUSAL. THE COURT THEREFORE CANNOT ORDER MODIFICATION OF DEFENDANT'S BMV RECORD AS IT DOES NOT LIST A CONVICTION FOR THE UNDERLYING OFFENSE OF OPERATING A VEHICLE WHILE UNDER THE INFLUENCE OF ALCOHOL OR DRUGS OF ABUSE OR A REFUSAL.

This Day, March 25, 2026 This matter came on for consideration. It is the order, judgment and decree of this court that The Court, having stayed the Administrative License Suspension at the request of the Defendant, pursuant to O.R.C. 4511.196 hereby suspends the driver's license of the Defendant while this matter is pending. Based upon the allegations contained in the citation and the Defendant's results from the Court's Pretrial Services evaluation, the Court finds that the Defendant's continued driving is a threat to public safety. The Defendant is hereby granted limited driving privileges for employment and court; however, the Defendant shall not consume or possess any alcohol or illegal drugs, and the Defendant may only drive a vehicle that is equipped with an Ignition Interlock Device. The receipt of any Ignition Interlock violations will result in the immediate termination of all driving privileges. The Defendant shall be responsible for all costs associated with the Ignition Interlock Device and shall make all payments in a timely fashion.
