This matter came to be heard at pre-trial. Based on pre-trial negotiations, the defendant hereby withdraws his/her not guilty plea and enters a plea of guilty to the amended allegations in the complaint or citation. The State of Ohio hereby moves to amend the charge due to conflicting evidentiary issues in the report, the Defendnad has a good driving record, and completed the Ohio Department of Public Safety Distracted Driving Safety Course prior to coming to court. The State further moves to strike reference to the Distracted Driving Enhancement on the face of the citation due to completing said safety course. The defendant hereby waives his/her right to counsel, right to jury trial or court trial, right to confront and subpoena witnesses and right to have the plaintiff prove his/her guilt beyond a reasonable doubt.
It is therefore ORDERED, ADJUDGED AND DECREED that the defendant is found to be guilty of the amended offense of City Ordinance 337.22(b) OBSCURRED WINDSHIED and is hereby sentenced to a fine of $150.00 plus court costs.
