NOW COMES THE STATE OF OHIO AND DEFENDANT, CHRISTOPHER R GRAJEDA, BY AND THROUGH THEIR RESPECTIVE COUNSEL, AND RESPECTFULLY REQUEST THE COURT TO APPROVE AND ADOPT THE FOLLOWING WRITTEN BOND FORFEITURE, PURSUANT TO PRE-TRIAL NEGOTIATIONS, AS FINAL JUDGMENT ENTRY IN THE CAPTIONED MATTER.
BY INFORMATION AND BELIEF, COUSNEL FOR DEFENDANT REPRESENTS THAT THE DEFENDANT IS A RESIDENT OF PAMPA, TEXAS,
THE STATE OF OHIO HEREBY AGREES TO DISMISS THE VIOLATIONS OF ORC 4520.12A1, NO OPERATOR'S LICENSE, AND ORC 4511.33A1 (RULE FOR DRIVING IN MARKED LANES) WITHOUT COST TO DEFENDANT. DEFENDANT CONSENTS TO THE DISMISSAL, AND EXECUTES THIS JUDGMENT ENTRY AND BOND FORFEITURE TO THE REMAINING CHARGE OF ORC 4511.19A1A (OVI).
THIS CASE SHALL BE DEEMED CLOSED AND NO FURTHER ACTION SHALL BE TAKEN. FURTHER, BECAUSE THIS IS A BOND FORFEITURE, THERE IS NO CONVICTION FOR THE UNDERLYING CHARGE OF OPERATING A MOTOR VEHICLE WHILE UNDER THE INFLUENCE OF ALCOHOL, A DRUG OF ABUSE, OR A COMBINATION OF THEM, R.C. 4511.19(A)(1)(A). SEE STATE V STUBER, 3RD DIST. NO. 5-02-49, 2003-OHIO-2938. UPON DUE CONSIDERATION, AND FOR GOOD CAUSE SHOWN, THIS COURT ACCEPTS DEFENDANT'S BOND FORFEITURE AND HEREBY ORDERS, ADJUDGES, AND DECREES THAT DEFENDANT'S BOND IN THE AMOUNT OF SEVEN HUNDRED FIFTY DOLLARS ($750.00), POSTED CONTEMPORANEOUSLY HEREIN, IS FORFEITED, IN LIEU OF APPEARANCE.
