Judgment This Day, November 12, 2025 This matter came on for consideration. It is the order, judgment and decree of this court that This matter came before the Court today on the Defendant’s Motion to Return to the Residence. Assistant Prosecutor Elliott Werth appeared on behalf of the State. The Defendant appeared with counsel, Attorney Jeff Whitman.
Prior to the hearing, the Prosecutor and defense counsel conferred and advised the Court that they have reached a framework for resolving the issue raised by the Defendant’s motion. The parties further advised that the alleged victim is no longer residing at the property.
Prosecutor Werth stated that he does not object to the Defendant’s request, provided the information is verified. Accordingly, this matter shall be continued to allow the Pretrial Supervision Officer time to confirm the alleged victim’s residence status.
