Judgment This Day, August 20, 2024 This matter came on for consideration. It is the order, judgment and decree of this court that This matter comes before the Court upon review of the Magistrate's Decision in this matter. The Court cannot approve of the Magistrate's Decision in the Sentencing Entry, line 2, where the Defendant is placed under a 90-day operator's license suspension. This is not permitted under the Ohio Revised Code for this type of offense. There is a mandatory operator's license suspension for a minimum period of 180 days. In addition, the Defendant is entitled to 30 days of jail credit for time served. Therefore, the Court hereby modifies the Decision and grants the Defendant 30 days of jail credit for time served and imposes the mandatory minimum 180-day operator's license suspension.
