MAGISTRATE’S DECISION
(Criminal Rule 19(D)
This 2nd day of June 2026, this matter came on to be heard upon the Court’s Motion to determine if the Defendant has the ability to pay his fines and costs. The Court finds that the Defendant is present in Court unrepresented. The State of Ohio was not present.
On April 21, 2026, the Court advised the Defendant of his right to an attorney. The Court placed the Defendant under oath. The Defendant presented evidence. From the evidence adduced at hearing, the Court makes the following findings of fact:
1. Defendant was employed at Captain Ds from October 2025 to February 2026.
2. Defendant was employed at Dennys from March 2026 to April 2026.
3. Starting June 3, 2026, the Defendant begins employment with Bellacino’s Pizza and Grinders on Tiffin Ave in Findlay, Ohio.
4. The Defendant will be working between 30 to 35 hours per week at $13.00 per hour.
5. Bellacino’s current manager has been accepted to nursing school and will be leaving Bellacino’s in 1.5 months.
6. Defendant is being trained to replace the current manager when he leaves for nursing school.
7. The Defendant’s gross weekly earnings for 32.5 hours per week is $422.50.
8. Currently, the Defendant is on felony probation with Hancock County Common Pleas. The Defendant has completed the requirements FRC has required, and the Defendant believes he will be released from probation very soon.
9. The Defendant does not have any health problems.
10. The Defendant is residing at 1711 Carlin Ave Findlay, Ohio.. He resides with his girlfriend, Jill Waller. The agreement between Waller and the Defendant is that each pays 50% of the rent and utilities. The monthly rent is $650 and the aggregate monthly utilities are $200.00.
11. The Defendant monthly living expenses is $425.00 (rent $325 and utilities $100).
12. The Defendant is under 5 separate child support orders. Four of the orders are arrearage only and 1 order is for a current child support order. The combined arrearage only payment is $200 per month and the current order is $52 per month for an aggregate monthly child support payment of $252.00.
13. The Defendant does not have a driver’s license or a car.
14. The Defendant does not have any credit card or medical debt.
15. The Defendant does not have any other monthly expenses.
16. The Defendant testified that he has the ability to pay a minimum of $50.00 per month on his fines and costs beginning June 2026.
17. The Defendant testifies that his first payment will be June 5, 2026.
Based on the above findings and facts, the Magistrate makes the following recommendations:
a. The Court should find that the Defendant does have the ability to pay as of June 2, 2026.
b. The Court should find the Defendant has the ability to pay a minimum of $50.00 per month with the first payment on June 5, 2026.
c. The Court should schedule an Ability to Pay Review hearing for September 22, 2026 at 9:00 AM.
The Defendant waived the 14 day objection period.
The party is advised that he has a period of fourteen (14) days from the filing of this Magistrate’s Decision in which to file written objections to this Decision in accordance with Ohio Criminal Rule 19(D) and rules of this Court. The party is further advised that “a party shall not assign on appeal the Court’s adoption of any factual finding or legal conclusion, whether or not specifically designated as finding of fact or conclusion of law under Crim. R. 19(D)(3)(a)(ii), unless the party has objected to that finding or conclusion as required by Crim. R. 19(D)(3)(b).”
See Crim. R. 19(D)(3)(b)(iv). The objecting party shall file the transcript or affidavit with the Court within thirty days after filing objections unless the court extends the time in writing for preparation of the transcript or other good cause. Crim. R. 19(D)(3)(b)(iii).

The defendant entered an admission to the alleged contempt citation. The Court finds the defendants admission was made knowingly and voluntarily and therefore finds the defendant to be in contempt for failing to complete the community service as ordered by the Court:
_X___ The defendant shall serve _10__ days in jail. The jail term shall be scheduled by the Clerk's office and shall commence in approximately_30__ days. The defendant is ordered to pay all costs of confinement in a jail or other residential facility pursuant to R.C. 2929.28, including but not limited to, a per diem fee for room and board in the jail of up to $108.00 per day, and any other costs provided by statute.
