MAGISTRATE’S DECISION
(Criminal Rule 19(D)
This 10th day of February 2026, this matter came on to be heard upon the Court’s Motion to determine if the Defendant has the ability to pay her fines and costs. The Court finds that the Defendant is present in Court represented by Attorney Paul Maekask. The State of Ohio was not present.
The Court placed the Defendant under oath. The Defendant presented evidence. From the evidence adduced at hearing, the Court makes the following findings of fact:
1. The Defendant has been a temporary worker with Surge Temp Service since 2019. His last contract with Surge was in 2025. Surge placed the Defendant with CSP/Tejin. Defendant worked 62 days and earned $6,105.10 in gross wages. Defendant did not have any other income in 2025.
2. In 2024, the Defendant was employed by Surge Temp Service. The Defendant’s gross earnings in 2024 were $1,045.00
3. For 2024, Defendant was incarcerated in the Allen County jail for 3 months for non-payment of child support and incarcerated for 6 months for an assault conviction. Defendant was released from the Allen County jail on 9/23/2024.
4. The Defendant is residing at 603 S Poe Rd North Baltimore, Ohio Apartment 24. He resides with his sister and Finance, Samatha Titus. Defendant’s sister does not require the Defendant to pay rent or utilities until he becomes employed.
5. The Defendant is under 4 separate child support orders: a) one order with Wyandot County for 82.00/month, b) two orders with Hancock County for 152.00/month and 80.00/month; c) one order with Allen County for 152.00/month and owes $1,000 in child support arrearages. His total monthly child support obligation is $466.00.
6. The Defendant does not have any other monthly expenses.
7. The Defendant does not have any bank accounts.
8. The Defendant does not have a car or a driver’s license.
9. The Defendant testified that Surge Temp Service has called him to fulfill a contract with Diamond Plating. He is scheduled to take a drug screen on 2/10/2026, and if Defendant passes the drug screen, he will be placed with Diamond Plating on 2/16/2026 to start work.
10. The placement at Diamond Plating is direct hire after working 720 hours or 90 days.
11. The Defendant testified that he has the ability to pay on his fines and costs beginning in approximately 30 to 45 days.
Based on the above findings and facts, the Magistrate makes the following recommendations:
a. The Court should find that the Defendant does not have the ability to pay as of February 10, 2026.
b. Since the Defendant indicated to the Court that he will have the ability to pay in 30 to 45 days, the Court should schedule an Ability to Pay Review hearing for April 14, 2026 at 9:00 AM.
The Defendant waived the 14 day objection period.
The party is advised that he has a period of fourteen (14) days from the filing of this Magistrate’s Decision in which to file written objections to this Decision in accordance with Ohio Criminal Rule 19(D) and rules of this Court. The party is further advised that “a party shall not assign on appeal the Court’s adoption of any factual finding or legal conclusion, whether or not specifically designated as finding of fact or conclusion of law under Crim. R. 19(D)(3)(a)(ii), unless the party has objected to that finding or conclusion as required by Crim. R. 19(D)(3)(b).”
See Crim. R. 19(D)(3)(b)(iv). The objecting party shall file the transcript or affidavit with the Court within thirty days after filing objections unless the court extends the time in writing for preparation of the transcript or other good cause. Crim. R. 19(D)(3)(b)(iii).
