Judgment Entry:
This matter came before the court for an arraignment. The matter was scheduled at 8:30 a.m. The Defendant appeared at 9:29 a.m. and was disruptive to Court proceedings upon entering the Courtroom. The Defendant was using his cellphone and was showing his phone to another individual who was seated in front of him. The Court advised the Defendant that cellphone usage is prohibited in the Courtroom and instructed the Defendant to turn his cellphone off. The Defendant argued with the Court and stated that he was not using his cellphone. The Court again instructed the Defendant to turn his cellphone off or the Court Officer would take and hold his cellphone until the proceedings were completed for the morning.
Upon calling the Defendant’s cases, the Defendant came forward to the Defense Counsel table and placed his cellphone on the table. The Court attempted to arraign the Defendant and attempted to inquire as to whether or not he had received the criminal complaints and traffic tickets and attempted to advise the Defendant of the nature of the offenses and potential penalties he is facing. The Defendant refused to stop interrupting the Court despite numerous Orders for him to do so. The Defendant advised the Court that he was recording the proceedings despite the Court’s Order and prohibition on cellphone usage and recording of proceedings. The Defendant refused to turn his cellphone off and refused to stop interrupting the Court and to allow the Court to arraign him on the charges. The Court Officer took the defendants phone to hold during the rest of the proceeding. The Court again attempted to arraign the defendant however the defendant continued to interrupt. The Court took a recess so that the Defendant could take a moment to decide if he was going to allow the Court to arraign him. Court staff attempted to talk with the Defendant in an effort to calm him down and to explain the purpose of the proceedings. The defendant continued to be argumentative with court staff and advised he wanted to call his attorney. The defendant was provided his phone at which time he appeared to have called and connected with an individual. After some time, the Defendant chose to leave the Courtroom without leave of the Court and failed to be arraigned on the charges.
As such, these matters are continued to Wednesday, February 1, 2023 at 8:30 a.m. If the Defendant fails to appear bench warrants may issue. If the Defendant does appear he shall not use his cellphone in the Courtroom, he shall not be disruptive to the proceedings and he shall abide by the Orders of the Court. Failure to do so may result in the Defendant being found in Contempt.
