CONSENT ENTRY FOR AMENDMENT AND BOND FORFEITURE IN LIEU OF APPEARANCE
THIS MATTER CAME BEFORE THIS COURT ON THE REQUEST OF THE STATE OF OHIO AND DEFENSE COUNSEL TO AMENDING THE (A) COUNT, AN ORIGINAL CHARGE OF OPERATING A VEHICLE WHILE INTOXICATED UNDER 4511.19 (A)(1)(a), TO A VIOLATION OF RECKLESS OPERATION UNDER 4511.20. ALL PARTIES HAVE STIPULATED AND AGREED THAT THIS VIOLATION SHALL BE CONSIDERED A SECOND PREDICATE OFFENSE IN ONE YEAR AND SHALL BE CHARGED AS A MISDEMEANOR OF THE FOURTH DEGREE. THE DEFENDANT HAS ALSO AGREED TO THIS AMENDMENT AND HAS WAIVED ANY DEFECTS IN TIME, PLACE, AND MANNER OF SERVICE OF THE AMENDED CHARGE.
FURTHERMORE, IT AS BE AGREED UPON THAT THE STATE SHALL DISMISS THE (:B) COUNT, A VIOLATION OF OPERATING A VEHICLE WHILE INTOXICATED-BREATH 4511.19 (A)(1(D). AS FOR THE REMAINING CHARGES, DEFENSE AND THE STATE REQUESTS FORFEITURE BOND IN THE AMOUNT OF $500.00 DOLLARS IN LIEU OF APPEARANCE AS TO THE AMEND CHARGE AS WELL AS THE REMAINING (C) COUNT, A SPEEDING VIOLATION UNDER 4511.21 (D)(4). IT HAS BEEN AGREED UPON THAT THE DEFENDANT SHALL NOT BE REQUIRED TO ATTEND ANY FUTURE COURT HEARINGS, AND IN EXCHANGE, SHALL FORFEIT THE BOND THAT HAS BEEN POSTED IN THE ABOVE CAPTION CASE. IT IS FURTHER AGREED THAT THIS FORFEITURE IN LIEU OF APPEARANCE SHALL NOT BE TREATED AS A CONVICTION IN ACCORDANCE WITH VILLAGE OF CAREY V WALTON, 3RD DIST. WYANDOT NO. 16-89-20, 1990 WL 197888.
IT IS THEREFORE ORDERED, ADJUDGED AND DECREED THAT THE OFFENSE OF OPERATING A VEHICLE WHILE INTOXICATED UNDER 4511.19 (A)1()A) SHALL BE AMENDED TO A VIOLATION OF RECKLESS OPERATION UNDER 4511.20, A MISDEMEANOR OF THE FOURTH DEGREE. THE (B) COUNT OPERATING A VEHICLE WHILE INTOXICATED-BREATH 4511.19(A)(1)(D) SHALL BE DISMISSED, AND THE BOND POSTED SHALL BE FORFEITED IN LIEU APPEARANCE. AS TO THE AMENDED A CASE AND C CASE. NO CONVICTION SHALL BE ENTERED UPON THE RECORD.

This matter came on for consideration this day 10/11/2022. The defendant appeared in open court and was advised of the charge, penalty, available pleas, and legal rights. The Defendant suggested indigency and requested the appointment of counsel.
