Judgment This Day, October 12, 2022 This matter came on for consideration. It is the order, judgment and decree of this court that This matter comes before the Court by way of the Court being notified that the Defendant may be incarcerated in a jail facility. Defense Counsel filed a motion with the Court on Monday, October 10, 2022 asking for an Order allowing the Defendant to appear in plain clothes as it may be possible that she will incarcerated on the date of the jury trial. The Court granted the motion. The Defendant is not currently being held in a jail by any order of this Court. The Court is aware that the Defendant is currently incarcerated in the Wood County jail on two separate $50,000 bonds, with no ten percent allowed, issued by the Wood County Common Pleas Court on October 7, 2022. As of 4:30 pm on October 12, 2022, this Court has not been advised of or notified of the issuance by the Wood County Common Pleas Court of any warrant to convey the Defendant to the Findlay Municipal Court for her jury trial on October 13, 2022. The Court notes that approximately 36 jurors will be reporting for jury duty tomorrow morning in Findlay Municipal Court for this case. The Court recognizes that while jury service is a civic duty of a citizen, it does cause jurors to expend much time and effort and experience some inconvenience and adds significant court costs to the case. Due to the Defendant's current incarceration and bond not having been posted as of yet and no warrant to convey issued, the Court finds that there is a high likelihood that the Defendant will not be available and present for her jury trial tomorrow and that will cause unnecessary inconvenience and expense to the jurors. Therefore, the Court hereby vacates the jury trial on October 13, 2022 and further orders that the case be set for a jury trial on a date that the Defendant will be available. This matter comes before the Court as a result of a Jury Trial having been scheduled for October 13, 2022. Based upon a review of the record and that this matter is scheduled for a Jury Trial, IT IS HEREBY ORDERED as follows:
Both parties shall file with the Court any proposed instructions for the Jury on or before Monday, October 10, 2022. Judgment This Day, June 14, 2022 This matter came on for consideration. It is the order, judgment and decree of this court that This matter comes before the Court today on a motion to suppress filed by Defense Counsel on behalf of the Defendant. The Court heard the testimony of Officer Adelsperger of the Findlay Police Department who was the only witness to testify. The Court finds the testimony of Officer Adelsperger to be competent and credible. Based on the evidence properly before the Court, the Court finds that there were reasonable grounds to stop and detain the Defendant. The Court further finds there was probable cause to issue the citation to the Defendant for Driving Under Suspension in violation of C.O. 335.071(A). The Court further finds that the Defendant was advised of her Miranda warnings and that there was no violation of the Defendant's Fifth Amendment rights. Therefore, the Court overrules the Defendant's Motion to Suppress and the Motion to Suppress is denied. The matter shall be set for further proceedings. So ordered. ALAN D HACKENBERG JUDGE |

JUDGMENT ENTRY
This day this matter came on to be heard upon bond hearing pursuant to Criminal Rule 46. The Court finds that the Defendant was present pursuant to video conferencing due to her incarceration in CCNO. The Defendant’s attorney, Matthew Exton was present and Findlay Municipal Court’s Pre-trial Supervision Officer, Stephanie Crossman. From the evidence adduced at hearing, the Court makes the findings:
1. On 12/2/2021, the Defendant appeared for arraignment in case no 21 TRD 06914 and 21 TRD 06965. The defendant was release on an OR bond with the condition of no operation of a motor vehicle. A pre-trial was scheduled for 12/22/2021.
2. On 12/14/2021, the Defendant was cited for another Driving Under Suspension and Possession of Drug Paraphernalia having case no 21 TRD 07395 and 21 CRB 01905 respectfully. The arraignment in these 2 cases were continued to 12/30/2021. The Court finds that condition of OR bond in case no 21 TRD 06914 and 21 TRD 06965 was no operation of motor vehicle.
3. On 12/21/2021, Defendant failed to appear for her pre-trial in case no 21 TRD 06914 and 21 TRD 06965.
4. On 12/30/2021, the Defendant failed to appear for her arraignment on cases 21 TRD 007395 and 21 CRB 01905 and a warrant was issued.
5. On 1/8/2022, the Defendant was cited for her 4th Driving Under Suspension having case no 22 TRD 00112. The warrants were served and a surety bond was imposed. Soke Bail Bonds posted a surety bond and Defendant was ordered to appear on 1/12/2021.
6. On 1/12/2021, the Defendant appeared for her arraignment in Case No 22 TRD 00112. The Defendant was released on an OR bond with the condition of no operation of a motor vehicle. Approximately 30 minutes after her arraignment in Case No 22 TRD 00112, the Defendant was cited for her 5th Driving Under Suspension. Another violation for her bond conditions.
7. On 1/13/2022, the Prosecutor filed a motion to revoke bond, and said hearing was scheduled 1/25/2022. The Defendant failed to appear, and a warrant was issued for her arrest. The warrant was served, and the Defendant was released on an OR bond with the condition of no operation of motor vehicle and placed on pre-trial supervision with the Findlay Municipal Court’s Probation department and follow all rules of pre-trial supervision.
8. The Defendant was ordered to report to Probation on 2/2/2022, and she failed to report in violation of Pre-trial rule 4.
9. On 2/15/2022, the Defendant failed to appear for her Status Conference hearing and Pretrial for all pending cases.
10. On 2/24/2022, the Defendant tested positive for THC in violation Pre-trial rule 4.
11. The Defendant failed to report to probation on 3/2/2022 in violation of Pre-trial rule 4.
12. On 4/24/2022, the Defendant was arrested on an allegation of Domestic Violence.
13. On 4/25/2022, the Court arraigned the Defendant on the Domestic Violence charge and issued on OR bond and placed on pretrial supervision.
14. On 4/26/2022, the Defendant was scheduled for a suppression hearing in the Driving Under Suspension offenses. The Defendant appeared 43 minutes late. The trial judge release her on a “Zero Tolerance” bond conditions and to follow the rules of Pre-trial supervision and be fitted with a GPS monitor.
15. On 4/26/2022, the Defendant violated curfew in violation of Pre-trial rule 12.
16. On 4/27/2022, the Defendant violated curfew on 3 occasions in violation of Pre-trial rule 12.
17. On 4/29/2022, the Defendant failed to report to probation, and later, Defendant admitted to the Probation officer of using Cocaine and Fentanyl.
Base on the hereinabove findings, the Court orders the following:
In Case No. 21 CRB 01905,
The Court grants an OR bond with the condition
1. No possession or consumption of alcohol or drugs of abuse and no possession of drug paraphernalia or drug abuse instruments.
2. Appear for all Court hearings and appear on time.
3. Defendant is placed on Pre-trial supervision and follow all conditions of pre-trial supervision.
In Case No. 22 CRB 00050,
The Court sets bond in the amount of $1,500 cash or surety with the condition:
1. Appear for all Court hearings and appear on time.

2. Defendant is placed on Pre-trial supervision and follow all conditions of pre-trial
The Court orders that additional conditions of pretrial supervision is that the Defendant shall be fitted with a GPS monitor. If the Defendant posts bond and is released, she must immediately report to Findlay Municipal Court’s Probation Department to be fitted for GPS monitor. If the Defendant seeks drug and alcohol treatment, the Court further orders the Defendant to sign any and all medical releases necessary for Findlay Municipal Court’s Probation Department to communicate with the Defendant’s counselors and/or drug treatment professionals.
