Journal This Day, October 28, 2020 This matter came on for hearing. It is the order, judgment and decree of this court that This matter came before the Court the 28th day of October, 2020 for a change of plea hearing. The State of Ohio was represented by Assistant Law Director, Marshall W. Finelli. The defendant was present with his retained counsel, W. Alex Smith. The Court was advised the defendant was not desirous of entering a change of plea and requested the matter be scheduled for jury trial. The status of plea negotiations was placed on the record and the defendant acknowledged he was rejecting the plea offer. The matter is to be scheduled for a jury trial.
Counsel for the defendant orally withdrew the motion to suppress evidence filed by prior counsel. Upon inquiry by the Court, the defendant agreed to the withdraw of the motion.
Whereupon, the Court inquired of the defendant regarding his right to a speedy trial. The defendant waived his speedy trial rights under the United States and Ohio Constitutions. The Court found the defendant's waiver to be made knowingly, intelligently and freely.
The Court reviewed with the defendant the conditions of his bond including that he not consume alcohol and seek a substance abuse evaluation. The defendant acknowledged he was aware of the conditions and was seeking treatment through Family Resource Center. All bond conditions remain in full force and effect.
