2/12/2020 |
Judgment This Day, February 12, 2020 This matter came on for hearing. It is the order, judgment and decree of this court that This matter came on for a change of plea hearing this 12th day of February, 2020. The State of Ohio was present and represented by Assistant Law Director, Marshall W. Finelli. The defendant was present and represented by his attorney, Paul Maekask. The Court inquired of the defendant regarding the charges. The defendant entered a plea of No Contest to the charge of falsification, a violation of R.C. 2921.13(A)(3), a misdemeanor of the first degree. The Court advised the defendant regarding the nature of the charge, the potential penalties that could be imposed and the various rights he was giving up by entering the plea. The Court found the defendant was entering the plea freely and voluntarily with a full understanding of the rights he was giving up and the potential penalties. The Court accepted the defendant's plea. Based upon a waiver of the investigative report being read into the record and the defendant consenting to a finding of guilt, the Court finds the defendant guilty of the offense of falsification, a violation of R.C. 2921.13(A)(3), a misdemeanor of the first degree. Pursuant to the plea negotiations, the disorderly conduct charge in violation of R.C. 2917.11(B)(2) is hereby dismissed at the costs of the defendant.
Whereupon, counsel for the defendant requested the matter be continued for purposes of sentencing in order for the defendant to resolve several pending matters in the Wyandot County, Ohio Court of Common Pleas. The State had no objection to the continuance request. The Court directs the matter be continued for sentencing in approximately sixty (60) days.
All until further ORDER of the Court.
