MAGISTRATE’S DECISION
(Criminal Rule 19(D)
This 4th day of August 2026, this matter came on to be heard upon the Court’s Motion to determine if the Defendant has the ability to pay his fines and costs. The Court finds that the Defendant is present in Court represented by Attorney, Paul Maekask. The State of Ohio was not present.
An evidentiary hearing was conducted. From the evidence adduced at hearing, the Court makes the following findings of fact:
1. The Defendant is homeless. He is currently living under a rain fly with a hammock. The property owner is allowing him to reside on the property, as long as, he keeps the property free of trash and debris. The property owner also requires him to clean out brush piles.
2. Prior to living under a rain fly, the Defendant was squatting in an abandoned RV located behind Buffalo Cartridge off Broad Ave.
3. The Defendant has a mailing address of 2719 Hollybrook Dr Findlay, Oh. It is his mother’s residence.
4. The Defendant is currently unemployed. His last job was with Sharp’s Landscaping in June 2026. Defendant worked 1 day.
5. Prior to Sharp’s Landscaping, the Defendant’s last employer was Logan Creative Decking. Defendant could not remember the dates of employment with Logan Creative Decking.
6. The Defendant does not own a car or have access to a car.
7. The Defendant testified that Surge Staffing will call him with job placements. However, the job placements are in Carey or Upper Sandusky. The Defendant refuses to take work assignments because he has no transportation to the job.
8. The Defendant testified that he is good at fixing “things” and odd jobs.
9. The Defendant finds items on Facebook Marketplace to restore and resell for a profit.
10. During the summer, the Defendant has flipped 8 or 9 bicycles at a profit of $20.00 to $40.00 per bike.
11. The Defendant stated that he has his state issued ID and is able to obtain employment.
12. The Defendant testified that he will have employment in the next 90 days.
13. The Defendant waived the 14-day objection period on the Magistrate’s decision.
Based on the above findings and facts, the Magistrate makes the following recommendations:
a. The Court should find that the Defendant does not have the ability to pay as of August 4, 2026.
b. The Court should schedule an Ability to Pay Review hearing on November 3, 2026 at 9:30am.
The party is advised that he has a period of fourteen (14) days from the filing of this Magistrate’s Decision in which to file written objections to this Decision in accordance with Ohio Criminal Rule 19(D) and rules of this Court. The party is further advised that “a party shall not assign on appeal the Court’s adoption of any factual finding or legal conclusion, whether or not specifically designated as finding of fact or conclusion of law under Crim. R. 19(D)(3)(a)(ii), unless the party has objected to that finding or conclusion as required by Crim. R. 19(D)(3)(b).”
See Crim. R. 19(D)(3)(b)(iv). The objecting party shall file the transcript or affidavit with the Court within thirty days after filing objections unless the court extends the time in writing for preparation of the transcript or other good cause. Crim. R. 19(D)(3)(b)(iii).
