4/24/2024 MAGISTRATE'S DECISION (Criminal Rule 19(D) This 23rd day of April 2024, this matter came on to be heard upon the Court's Motion to determine if the Defendant has the ability to pay his fines and costs. The Court finds that the Defendant is present in Court represented by Attorney, Dorothy Williams. The State of Ohio was not present. The Court placed the Defendant under oath. The Defendant presented evidence. From the evidence adduced at hearing, the Court makes the following findings of fact: 1. The Defendant is residing with his Father and Step-Mother at 134 Laquineo St Findlay, Ohio. He had been living with his Father for the last 2 years, since his release from pnson. 2. The Defendant's Father charges the Defendant $100.00 per month in rent. His Father does not require the Defendant to pay any of the household utility costs. 3. The Defendant testified that he pays $400 per month in groceries and eating out. The Defendant pays $55 per month in toiletries and other personal items. The Defendant has a cell phone bill of $55.00 per month. 4. The Defendant testified that he has a 14 year old son. His Father and Step-Mother have custody of the Defendant's son. Defendant's father was receiving SSI benefits for Defendant's son, but the SSI payments were discontinued. Just recently, Defendant's Father has filed an administrative action with the Child Support Enforcement Agency against the Defendant for an order of child support. Currently, the Defendant is not under a child support order. The Defendant has not had his hearing at the time of the hearing, however, the Defendant is expecting a child support order of $140.00 per month. 5. The Defendant presented an IRS bill for tax year 2017 for outstanding taxes of $13,760.76. However, the Defendant testified that he has not contacted the IRS for a payment plan. He further testified that he has not made any payments toward his 2017 tax obligation. 6. The Defendant presented evidence of creditors which included credit cards, utility companies, and venders. Exhibits E and G. The outstanding debt owed is $18,928.10. However, the Defendant testified that all outstanding debt was incurred in 2019 and in prior years. The Defendant has not incurred any additional debt since 2019. 7. The Defendant testified that only Capital One and American Express are still pursuing collections on the money owed. However, the Defendant stated that he has not entered into a payment plan with either creditor and is not paying either creditor. 8. On October 18, 2023, the Defendant started work at United Parcel Service (UPS) loading packages into trucks. The Defendant works parttime Monday through Friday from 10:00 am to 2:00pm depending on the number of packages required to be loaded. His average work week consists of 17 to 18 hours. The Defendant is paid $21.00 per hour. He is expecting a $2.00 to $3.00 per hour raise in October, 2024. 9. The Defendant testified that he bid for full time work which would consist of loading trucks in the morning and unloading packages in the afternoon. However, the bidding process is based on seniority and Defendant did not have enough seniority. The Defendant believes that he will be hired full time at the next bid. Currently, the Defendant is employed by UPS. 10. The Defendant provided his 2023 W2s. Exhibit A. The Defendant's gross income for 2023 was $10,976.49. 11. The Defendant provided 12 pay stubs of various dates from 10/21/2023 through 2/24/2024. Exhibit B. The Defendant submitted a summary sheet of his weekly take home pay from 10/21/2023 to 3/9/2024. Exhibit F. By extrapolating 17 weeks of net weekly income into months [($6,212.27/17 weeks) *(52 weeks)/12 months], this calculates to $1,583.52 of monthly net income. 12. The Defendant has no other sources of income. 13. The Defendant has a 2008 Chevy that he paid $400 to purchase it. The Chevy does not run. The Defendant testified that the cost of repairs are more than the car is worth. The Defendant has a drivers license. 14. The Defendant pays $160 per month to a co-worker to transport him to and from work. 15. The Defendant testified that he has the ability to pay on his fines and costs. 16. The Defendant testified that he has the ability to pay $10.00 per week pursuant to a wage assignment. 17. The Court prepared an ability worksheet based on the exhibits and testimony attached hereto. The Court finds that the Defendant has $379 of disposable income remaining after expenses. Based on the above findings and facts, the Magistrate makes the following recommendations: a. The Court should find that the Defendant does have the ability to pay his fines and costs. b. The Court should find the Defendant has the ability to pay $10.00 per week and allow the Defendant to enter into a wage assignment or $10.00 per week. The party is advised that he has a period of fourteen (14) days from the filing of this Magistrate's Decision in which to file written objections to this Decision in accordance with Ohio Criminal Rule 19(D) and rules of this Court. The party is further advised that "a party shall not assign on appeal the Court's adoption of any factual finding or legal conclusion, whether or not specifically designated as finding of fact or conclusion of law under Crim. R. 19(D)(3)(a)(ii), unless the party has objected to that finding or conclusion as required by Crim. R. 19(D)(3)(b)." See Crim. R. 19(D)(3)(b)(iv). The objecting party shall file the transcript or affidavit with the Court within thirty days after filing objections unless the court extends the time in writing for preparation of the transcript or other good cause.
