Judgment This Day, October 09, 2020 This matter came on for hearing. It is the order, judgment and decree of this court that This matter came before the Court the 9th day of October, 2020 on a "Motion to Release Warrant and Give the Defendant Time Served for his Suspended Sentence" filed by counsel for the defendant. A review of the file in this case shows the defendant was convicted on January 15, 2019 of Driving Under Suspension in violation of R.C. 4510.11(A), a misdemeanor of the first degree. The defendant was sentenced sixty days in jail with fifty days suspended on the condition the defendant perform 100 hours of community service. The defendant never registered for the community service. Consequently, on June 10, 2019 a warrant was issued for his arrest to serve the previously suspended ten day sentence. According to the defendant's motion, the defendant was held in custody for 114 days which the defendant now seeks to have satisfy the sentence in this case.
It is unclear why the defendant was incarcerated. The record in the instant case is clear the defendant has yet to serve any jail term in this matter and the Hancock County Justice Center does not have a record of his incarceration. The jail sentence was suspended on the condition the defendant perform 100 hours of community service, which was never completed. Further, there is no explanation why the defendant delayed sixteen months after his release from custody to address the situation.
Upon consideration, the Court finds the motion not well taken. Accordingly, the motion is DENIED. Should the defendant desire to complete the community service, he may report to the Court's Compliance Officer by October 23, 2020 to reregister for community service. The bench warrant will be recalled at that time.
