Judgment This Day, August 10, 2017 This matter came on for hearing. It is the order, judgment and decree of this court that This matter came before the Court this 9th day of August, 2017 for a hearing on a Motion to Sell Immobilized Vehicle and a Motion to Release Vehicle and Vacate Hearing filed by counsel for the defendant. The State of Ohio was present and represented by assistant prosecutor, Robert E. Feighner. The defendant was represented by attorney Paul Maekask. Counsel met with the Court in chambers and reviewed the defendant's driving history as contained in a certified driving record provided by the Ohio Bureau of Motor Vehicles. Counsel for the defendant advised the driving history he was provided was not complete and concurred that the vehicle in question was subject to forfeiture pursuant to Codified Ordinance 335.071(b)(1)(C). Accordingly, both of the defendant's motions are OVERRULED.
The Court was further advised the defendant has Case Numbers 15-TRC-10820 and 15-TRD-11254 pending on Judge Hackenberg's docket for hearing on a Notice of Violation of Probation scheduled for August 28, 2017. Counsel for both parties suggested consolidating all of the defendant's cases for a global resolution. After conferring with Judge Hackenberg, it was determined to be in the interest of judicial economy that this matter be transferred to Judge Hackenber's docket. Accordingly this matter is ORDERED transferred to the docket of Judge Hackenberg. The pre-trial conference scheduled in this case for August 30, 2017 is hereby vacated.
