Judgment This Day, February 28, 2017 This matter came on for hearing. It is the order, judgment and decree of this court that This matter came on for consideration this 28th day of February, 2017 upon a request by the defendant to lift the bench warrant that was issued as a result of his failure to appear for a Fines and Cost hearing. In a communication to the Court filed on February 6, 2017 the defendant indicated he would pay one hundred dollars ($100.00) a month beginning on March 1, 2017. Accordingly, the Court declines to withdraw the bench warrant at this time. Instead, the Court will wait to see if the defendant makes the payment as he promised. If the payment is received by March 15, 2017 the Court will withdraw the bench warrant.
The Court also notes the defendant has failed to obtain an alcohol/substance abuse assessment as he was ordered to do as part of the sentence imposed in this case. The defendant must obtain an assessment by a licensed counselor and submit proof of this evaluation to the Court's Compliance Officer by March 15, 2017. In addition, the defendant must pursue any treatment recommended by the counselor. If the defendant fails to submit proof of this evaluation as ordered, a bench warrant may be issued for his arrest.
