Judgment This Day, February 09, 2018 This matter came on for hearing. It is the order, judgment and decree of this court that This matter comes on for consideration this 9th day of February, 2018 upon the Court's own motion for an evaluation to determine the defendant's competency to stand trial pursuant to R.C. 2945.371(B). Upon a review of the pleadings filed by the defendant in this case and in consultation with the magistrates who conducted the defendant's arraignment/bond hearings, the Court finds the defendant's competence to stand trial is at issue. At the hearing conducted on January 10, 2018 the defendant advised the magistrate he did not understand several basic concepts and made other statements calling into question his ability to understand the nature and objective of the proceedings against him or in assisting in his own defense. It is therefore ORDERED that the defendant undergo an evaluation pursuant to R.C. 2945.37 and R.C. 2945.371 be conducted at an appropriate facility. Upon a receipt of a written report of the evaluation the Court directs that a hearing be held on the issue within ten days as required by R.C. 2945.37(C). The defendant's speedy trial time is tolled pursuant to R.C. 2945.72(B).
