Judgment This Day, December 07, 2017 This matter came on for hearing. It is the order, judgment and decree of this court that This matter comes on for consideration this 7th day of December, 2017 upon the request of the Hancock County Sheriff to afford persons working in the inmate worker program with credit against their sentence. Among the inmates participating in this program is Brett W. Fox.
R.C. 2947.151 provides, in part: "The sheriff in charge of a county jail may, upon consideration of the quality and amount of work done in the kitchen, in the jail offices, on the jail premises, or elsewhere, allow reductions of inmates' sentences . . ." The statute requires judicial concurrence of any sentence reduction and specifically states: "The reduction of the inmate's sentence shall become effective only upon the written concurrence of the presiding or sentencing judge or magistrate of the court where the sentence was imposed." Id. THe statute provides the Court with discretion whether to concur in the reduction of an inmate worker's sentence. Skapura v. McFaul, 54 Ohio St.2d 348, 8 Ohio op. 3d 356, 376 N.E.2D 1339 (1978). In addition, a court is not required to conduct a hearing on the issue or state its reasons for the refusal. Id.
The Court has been advised by the jail administration that the work performed by inmate Fox has been substandard and of such poor quality that inmate Fox is being removed from the inmate worker program. For example, the Court has been advised inmate Fox improperly added ingredients to food as it was being prepared, provided extra portions of food to other inmate workers and has been repeatedly failing to follow instructions regarding food disposal causing maintenance issues with the garbage disposal and plumbing.
Consequently, the Court being advised in the premises does NOT give its concurrence to the sentence reduction for inmate Brett W.Fox.
