This 26th day of November 2024, this matter came on to be heard upon the Court’s Motion to determine if the Defendant has the ability to pay his fines and costs. The Court finds that the Defendant is present in Court unrepresented. The State of Ohio was not present. The Defendant desires to proceed without counsel.
The Defendant presented evidence. From the evidence adduced at hearing, the Court makes the following findings of fact:
The Defendant resides with his Mother at 725 N Cory St Apt A Findlay, Ohio.
The Defendant stated that he was released from prison in October of 2018 or 2019.
The Defendant stated that he has been clean and sober for the last 5 years.
The Defendant is currently unemployed. The Defendant could not recall the last time he was employed and could not remember his last employer.
The Defendant testified that he has purposely been unemployed for the last 5 years.
The Defendant testified that he has no income and receives $250.00 in food stamps per month.
The Defendant stated that he has no monthly expenses, and his Mother does not charge him to reside with her.
The Defendant does not have any health problems, except for an eye injury, that prevents him from working. He stated that his eye injury does not prevent him from working.
The Defendant received his Ohio ID on November 18, 2024, and he further stated, that since he has an ID, he will be seeking employment.
The Defendant testified that he has the ability pay on his fines and costs once he obtains employment.
The Defendant testified that his plan for finding employment is to fill out applications at any employer with a specific employer of City Laundry.
The Defendant stated that he would be employed within 30 days.
Based on the above findings and facts, the Magistrate makes the following recommendations:
The Court should find that the Defendant does not have the ability to pay as of November 26, 2024.
The Court should schedule an ability to pay review hearing in 45 days.
The party is advised that he has a period of fourteen (14) days from the filing of this Magistrate’s Decision in which to file written objections to this Decision in accordance with Ohio Criminal Rule 19(D) and rules of this Court. The party is further advised that “a party shall not assign on appeal the Court’s adoption of any factual finding or legal conclusion, whether or not specifically designated as finding of fact or conclusion of law under Crim. R. 19(D)(3)(a)(ii), unless the party has objected to that finding or conclusion as required by Crim. R. 19(D)(3)(b).”
See Crim. R. 19(D)(3)(b)(iv). The objecting party shall file the transcript or affidavit with the Court within thirty days after filing objections unless the court extends the time in writing for preparation of the transcript or other good cause. Crim. R. 19(D)(3)(b)(iii).
