This Day, August 10, 2011 This matter came on for hearing. It is the order, judgment and decree of this court that These matters were scheduled before the Court for purposes of a Revocation hearing. Mr. Sass appeared on behalf of the Defendant and Ms. Wykes was present on behalf of the City of Findlay. At the request of Mr. Sass, the Defendant was brought to the courtroom from the jail, rather than appearing by video as had been originally planned. During a hearing conducted prior to these matters involving a different defendant, this Defendant became disruptive and had to be removed from the courtroom. The Defendant continued to be disruptive and became more belligerent as he exited the hearing. Although the Court finds that the actions of the Defendant interfered with the orderly, efficient, and effective pursuit of justice, the Court will defer any action on the Defendant's direct contempt. Mr. Sass requested that these matters be rescheduled and said request was granted without objection. This matter comes before the Court as a result of a Jury Trial having been scheduled for AUGUST 25, 2011. Based upon a review of the record and that this matter is scheduled for a Jury Trial, IT IS HEREBY ORDERED as follows:
Both parties shall, either 30 days before the jury trial or within 10 days of this entry (whichever is later), file with the Court proposed instructions for the Jury. Each party shall include specific references to all relevant portions of the Ohio Jury Instructions (OJI) and, if not included in OJI, specific references to relevant case law supporting the requested instruction(s). Additionally, counsel shall provide the Court with a CD/DVD containing the proposed instructions in a format compatible with Microsoft Word. The CD/DVD shall be delivered to room 208 of Findlay Municipal Court.
