This 28th day of October 2025, this matter came on to be heard upon the Court’s Motion to determine if the Defendant has the ability to pay his fines and costs. The Court finds that the Defendant is present in Court represented by Attorney, Todd Mosley. The State of Ohio was not present.
An evidentiary hearing was conducted. From the evidence adduced at hearing, the Court makes the following findings of fact:
The Defendant has lived with his father on Sandusky Ave in Findlay, Ohio since 2024. His father does not require the Defendant to pay any rent or utilities.
The Defendant is unemployed. His last employment was in May 2024 working at Superior Trim. He was laid off from Superior Trim and has not been employed since.
The Defendant was convicted of felony domestic violence in October 2018.
The Defendant does not have any health problems and is physically able to work.
The Defendant had an interview with Molten’s temporary employment agency, but the Defendant was not hired because of the felony conviction.
The Defendant has his information on In-Deed.com. Defendant was not hired by Gram Packaging or Findlay Vinyl because his felony conviction was not 7 years old.
The Defendant interviewed with McDonalds and Burger King, but he was not hired because of a petty theft conviction.
The Defendant states that Job and Family Services has a job fair next week, and he will be attending the job fair.
The Defendant does not have a car or a driver’s license. The Defendant owes reinstatement fees to BMV that must be paid before the Defendant’s license is valid.
The Defendant is receiving Medicaid benefits.
The Defendant is not under a child support order.
The Defendant does not have any bank accounts.
The Defendant’s father receives food stamps for groceries, and Defendant’s father pays all household expenses.
The Defendant’s cell phone bill is paid by his father.
Based on the above findings and facts, the Magistrate makes the following recommendations:
The Court should find that the Defendant does not have the ability to pay as of October 28, 2025.
The Court should place the Defendant on the Status Conference docket.
The Defendant waived the 14-day objection period on the Magistrate’s decision.
The party is advised that he has a period of fourteen (14) days from the filing of this Magistrate’s Decision in which to file written objections to this Decision in accordance with Ohio Criminal Rule 19(D) and rules of this Court. The party is further advised that “a party shall not assign on appeal the Court’s adoption of any factual finding or legal conclusion, whether or not specifically designated as finding of fact or conclusion of law under Crim. R. 19(D)(3)(a)(ii), unless the party has objected to that finding or conclusion as required by Crim. R. 19(D)(3)(b).”
See Crim. R. 19(D)(3)(b)(iv). The objecting party shall file the transcript or affidavit with the Court within thirty days after filing objections unless the court extends the time in writing for preparation of the transcript or other good cause. Crim. R. 19(D)(3)(b)(iii).
