JUDGEMENT ENTRY - This matter came on for Arraignment pursuant to Traffic Rule 13(B) on April 10, 2007. The Defendant appeared with counsel, Thomas D. Drake. Not one made an appearnace on behalf of the Registrar or the Bureau of Motor Vehicles or the State of Ohio.
Counsel for Defendant advised the Court that Defendant was ready to proceed with an Appeal of the Administrative License Suspension imposed against the Defendant on April 6, 2007, pursuant to Revised Code Section 4511.191(H)(1).
Due to the Registrar's inability to proceed, the Court, on its own Motion, continued this matter.
Pursuant to the ruling in State v. Hochhausler (1996), 76 Ohio St. 3d 455, the Court hereby Orders that the Defendant's Administrative License Suspension be stayed until such time as said appeal is concluded.
IT IS THEREFORE Ordered that the Defendant's operating privileges be restored, and that the Bureau of Motor Vehicles is Ordered to modify the Defendant's driving record in accordance with this Order.
