MAGISTRATE'S DECISION (CRIMINAL RULE 19(D)
This 6th day of December, 2022, this matter came on to be heard upon the Court's Motion to determine if the Defendant has the ability to pay his fines and costs. The Court finds that the Defendant is present in Court represented by his Attorney, Todd Mosley. The Court finds that on August 8, 2022, the Defendant was served a notice of hearing for the Court to determine the Defendant's ability to pay fines and costs.
Prior to the start of the hearing, the Defendant argued that the Court does not have the authority to collect the fine. The Defendant argued that the fine was imposed as a community control sanction on an offense that occurred more than 10 years ago. The Defendant further argued, that since more than 5 years have elapsed, the Court cannot collect the fine. This argument was visited in State v Burke 91 Ohio App. 3d 514 and State v Whitt (3d Dist) WL 697947. The Court in Burke stated.
"R.C. 2929.51(F)(2) reads:
(F) At the time of sentencing and after sentencing, when a fine is imposed, the court may:
"(2) Permit payment of all or any portion of the fine in installments, or by any other method and in any time and on any terms that the court considers just, except that the maximum time permitted for payment shall not exceed two years."
The purpose of R.C. 2929.51 (F)(2) is to permit the violator of a statute to order his financial affairs while retaining the punitive effect of a fine. "Permit" means "to allow; to tolerate; to agree; to afford opportunity for; to grant permission; to give leave." Webster's Encyclopedic Unabridged Dictionary of the English Language
(1989) 1073. Our interpretation of R.C. 2929.51(F)(2) is that the court has authority to let the violator pay his fine over a period of time rather than requiring payment in full when the fine is levied. We find no authority which places an affirmative duty on the court to hunt down and collect each payment. We believe this would subvert the clear intention of R.C. 2929.51(F)(2) because, to avoid the additional workload, courts could require that all fines be paid in full." Id at 517.
The Court in Burke further stated "We find nothing in R.C. 2929.51(F)(2) which states that the court must collect the fine within the two-year period but merely that it is authorized to accept payments in lieu of one lump sum. When initiating a payment plan, the court is authorized to grant sufficient time, up to two years, so that the payments will not work an undue hardship on the convicted party." Id at 518.
In State v Whitt, the Third District adopted the same rationale as in Burke. Supra. The Third District stated "There is nothing in RC 2929.51(F)(2) which states that the court must collect the fine within the two-year period. Instead, the statute merely authorizes courts to accept payments in lieu on one lump sum. Whitt at 3.
In the litany of cases above, RC 2929.51(F)(2) was in effect. RC 2929.51(F)(2) was repealed in 2004 and replaced with RC 2929.28(F)(2). When one compares the language of RC 2929.51(F)(2) to the modern day statue of RC 2929.28(F)(2), the language is virtually identical except the current statue allows the Defendant to make installment payments over a 5 year period instead of 2.
Based the rationale outlined in Burke and Whitt, and the court record, Court overruled Defendant and proceeded with hearing.
From the evidence adduced at hearing, the Court makes the following findings:
The Defendant has a history of employment. He has been employed at Wendys, Sanho, and TM Plastics.
The Defendant is currently employed with Hitachi since October, 2022.
The Defendant is an hourly employee at Hitachi earning $17.50 per hour.
The Defendant is a full time employee working an average of 30 hours per week.
The Defendant's weekly gross income is $525.00 which calculates to $2,275.00 per month.
6. The Defendant has $55.15 in taxes withheld from his weekly pay check which calculates to $238.98 per month in tax deductions. The Defendant is under two child support orders for an aggregate monthly obligation of $310.92.
7. After the deductions of tax withholdings and child support, the Defendant has $1,725.10 in disposable monthly income.
8. The Defendant does not have any other sources of income except Hitachi.
9. The Defendant resides in his Father's home and pays his Father rent in the amount of
$100 per week for a monthly rental obligation of $433.00. The Defendant is current in his rent.
10. The Defendant has the following household expenses:
Grocery bill of $200 per month.
Cell phone bill of $75.00 per month.
Transportation/gasoline costs of $200.00 per month. Defendant's girlfriend pays the car insurance and car payment. The Defendant has no car payment or car insurance cost.
The Defendant does not have any household utility expenses or trash removal costs.
The Defendant is on Medicaid so no health insurance cost.
The Defendant testified that he has no credit card debt, medical debt, and he has no outstanding loans.
The Defendant does not have any life insurance premiums.
The Defendant testified that he has a $9.50 per day cigarette habit which calculates to $285 per month. He further testified that he spends $30 per month on entertainment.
11. The Defendant has $1,223 in monthly household expenses including the Defendant's rent and cigarette habit. The Defendant has $502.10 per month remaining after the payment of his household expenses, taxes, and child support. ($1,725.10 disposable income - $1,223 household expenses).
12. The Defendant does not have any bank accounts, does not own a car, and does not own any real estate.
13. The Defendant testified that he can pay $50.00 per month towards is fines and costs.
Based on the above findings and facts, the Magistrate makes the following recommendations:
The Court should confirm the Magistrate's decision overruling the Defendant's Motion arguing the Court does not have authority to collect fines because 5 years have elapsed.
The Court should find that the Defendant does have the ability pay and has the ability to make regular payments.
The Court should accept Defendant's payment plan of $50.00 per month and allow the Defendant to enter into a wage assignment of $12.50 per week.
The parties are advised that they have a period of fourteen (14) days from the filing of this Magistrate's Decision in which to file written objections to this Decision in accordance with Ohio Criminal Rule 19(D) and rules of this Court. The parties are further advised that "a party shall not assign on appeal the Court's adoption of any factual finding or legal conclusion, whether or not specifically designated as finding of fact or conclusion of law under Crim. It 19(D)(3)(a)(ii), unless the party has objected to that finding or conclusion as required by Crim. R. 19(D)(3)(b)."
See Crim. R. 19(D)(3)(b)(iv). The objecting party shall file the transcript or affidavit with the Court within thirty days after filing objections unless the court extends the time in writing for preparation of the transcript or other good cause. Crim. R. 19(D)(3)(b)(iii).
